State Attorney Melissa Nelson announces that a Duval County jury found Rico McMillan guilty of Aggravated Battery with a Deadly Weapon. With the verdict, McMillan faces up to 30 years in Florida State Prison. The Honorable Mark Borello will sentence McMillan at a later date.

On May 31, 2022, the victim and McMillan were roommates, and the victim was giving McMillan a ride when they got into an argument. The argument escalated after they got out of the car, and McMillan grabbed a metal baseball bat out of the trunk and hit the victim in the face. McMillan ran from the scene. The victim happened to be on the phone with a friend at the time who heard the attack. Another witness nearby heard the victim puking, crying, and begging for help outside her home; when she walked outside, she saw the victim covered in blood talking to his friend who called 911. The victim was taken to the hospital for his injuries.

The case was investigated by the Jacksonville Sheriff’s Office and prosecuted by Assistant State Attorneys Dan Cardenas and Lizzie Brown.
