State Attorney Melissa Nelson announces that Duyane Milton was found guilty by a jury of Aggravated Assault with the Discharge of a Firearm. Milton now faces up to five years in Florida State Prison. The Honorable Don Lester will sentence Milton on March 1, 2022.

On Sept. 29, 2019, members of the Clay County Sheriff’s Office responded to a roadway in response to a call for service. Upon arrival, the minor victim told law enforcement he was riding Milton’s four-wheeler when Milton walked toward him, pulled out a handgun, pointed it at him, and fired three shots. Milton continued to approach the victim with the gun pointed at him and stated he was lucky he didn’t shoot him. Milton then took the vehicle and left. A witness observed the incident and relayed the same details to law enforcement. Milton was interviewed and said he fired two shots into the ground and was angry about the victim taking the vehicle for too long and taking it further than he wanted. A Florida Fish and Wildlife Conservation Commission K-9 was brought to the scene and found two rounds in close proximity to where the victim and witness said the altercation took place. Milton was arrested without incident.

The case was investigated by the Clay County Sheriff’s Office and Florida Fish and Wildlife. It was prosecuted by Assistant State Attorneys Jamie Cona and Sandra Brose.
