State Attorney Melissa Nelson announces that a Clay County jury found Radarius Swain guilty of two counts of Lewd or Lascivious Battery (12 to 16 years of age) and one count of Committing an Unnatural and Lascivious Act. With the verdict, Swain faces up to 30 years in Florida State Prison. The Honorable James Kallaher will sentence Swain at a later date.
On March 25, 2024, the victim’s parents found out Swain had been having sexual relations with their 15-year-old daughter. The victim’s phone was confiscated as evidence, and text messages were located between Swain and the victim wherein they discussed sexual acts that had taken place between the two of them. Swain would meet the victim at the community center clubhouse. Key card swipes from the community center confirmed Swain entered the women’s restroom to meet with the victim and have inappropriate and illegal relations.
The case was investigated by the Clay County Sheriff’s Office and prosecuted by Assistant State Attorneys Brandi Moravek and Cara Devlin.
